1. PLATFORM POSITION
Ryzoro LLC, operator of WestCoastSwingers.com, takes the position that it is NOT a “producer” as defined in 18 U.S.C. § 2257 and 28 C.F.R. § 75.1(c) with respect to content uploaded by Platform users, on the following grounds:
- WestCoastSwingers.com is an interactive computer service as defined under 47 U.S.C. § 230
- All visual depictions of sexually explicit conduct, including nude images, are User Content created and uploaded by Platform users, not by the Company
- The Company does not hire, contract with, manage, or direct performers depicted in User Content
- The Company does not produce, film, photograph, or create any sexually explicit content
- Pursuant to 28 C.F.R. § 75.8, secondary producers who receive and republish content are exempt from § 2257 record-keeping if they did not create the content
2. USER OBLIGATION AS PRODUCER
Each user who uploads sexually explicit content to the Platform is acting as the producer of that content and is solely responsible for compliance with 18 U.S.C. § 2257 and 28 C.F.R. § 75, including:

- Verifying and recording the age of every depicted person prior to production
- Obtaining and maintaining government-issued photo ID for every depicted person
- Maintaining records at their primary place of business or residence
- Making records available for inspection upon lawful request
- Retaining records for five years after the last publication of the content
3. PLATFORM RECORD-KEEPING PROCEDURES
Notwithstanding its exempt status, the Company maintains the following procedures as a best practice:
- Age confirmation checkbox required at registration
- Date of birth collected and verified at registration
- Explicit Content Upload Policy acknowledgment required before uploading explicit content
- User certification under penalty of perjury that all depicted persons are 18+ at each explicit upload
- Moderation review of uploaded explicit content
- Immediate removal and law enforcement reporting of any suspected minor content
4. CUSTODIAN OF RECORDS
For any content where the Company is deemed a producer, records are maintained by:
