EXPLICIT CONTENT UPLOAD POLICY

YOU MUST READ AND AGREE TO THIS POLICY BEFORE UPLOADING ANY NUDE OR SEXUALLY EXPLICIT IMAGES TO YOUR PROFILE.

1. PURPOSE

This Explicit Content Upload Policy governs the upload of nude and sexually explicit photographs to WestCoastSwingers.com. It supplements our Terms of Service and 2257 Compliance Statement. By uploading explicit content, you agree to this Policy in full.

2. WHAT IS PERMITTED

  • Nude photographs of yourself or consenting adults known to you
  • Sexually explicit photographs with documented consent of all depicted persons
  • Images where all depicted persons are verifiably 18 years of age or older
  • Images you own or have the right to upload

3. WHAT IS PROHIBITED

  • Any image where any depicted person appears to be under 18, regardless of claimed age
  • Any image of another person without their express documented consent
  • Images depicting sexual acts involving animals
  • Images depicting non-consensual scenarios of any kind, whether staged or real
  • Images depicting any illegal act
  • Images containing identifying information of non-consenting third parties
  • Images obtained without the depicted person’s knowledge
  • Stolen or downloaded explicit images of others

4. YOUR CERTIFICATIONS AT UPLOAD

By uploading any nude or explicit image, you certify under penalty of perjury that:

  • You are the producer of this content or have obtained it with full rights to distribute
  • Every person depicted was at least 18 years of age at the time of production
  • Every person depicted has expressly consented to this image being uploaded to this Platform
  • You possess age verification documentation (government-issued ID) for every depicted person
  • You possess written or recorded consent from every depicted person
  • You will maintain these records and provide them to the Company within 72 hours of request
  • This image does not violate any law or the rights of any third party

5. PLACEMENT RULES

  • Explicit images may only be uploaded to designated explicit photo sections of your profile
  • Your primary profile thumbnail (visible in the member directory) must be tasteful and non-explicit
  • Thumbnails may be clothed, lingerie, or swimwear photos — not sexually explicit
  • Full nudity and explicit content is accessible only when a member views your full profile

6. VISIBILITY AND PRIVACY

  • Explicit profile photos are visible ONLY to approved, logged-in members
  • Explicit content is never indexed by search engines
  • Explicit content is never accessible to guests or the general public
  • The Company cannot prevent other members from screenshotting your content
  • Upload explicit content only if you are comfortable with approved members viewing it

7. MODERATION

All uploaded images are subject to review. The Company reserves the right to remove any image at its sole discretion. Images that appear to depict minors will be removed immediately, the account will be terminated, and the content will be reported to NCMEC and law enforcement.

8. RECORD KEEPING

You are required to maintain the following records for all explicit content you upload:

  • A copy of a valid government-issued photo ID for every depicted person confirming they are 18+
  • Written or recorded consent from every depicted person
  • The date the image was created
  • The legal name and date of birth of every depicted person

These records must be maintained for as long as the content remains on the Platform and for five years thereafter. You must provide them to the Company within 72 hours of any request.

9. REMOVAL OF YOUR CONTENT

You may request removal of your explicit content at any time by deleting it from your profile or by contacting legal@westcoastswingers.com. Deleted content will be removed from active display, though backup copies may exist for a period of time consistent with our data retention practices.

10. VIOLATION CONSEQUENCES

Violations of this Policy may result in: immediate content removal, account suspension, permanent account termination, and referral to law enforcement. The Company’s decisions are final.
